Senators ought to have to actually talk on the floor to filibuster.
Technically they *do* have to talk on the floor to filibuster. It’s the threat of a filibuster that is preventing legislation from being taken up. So as long at 2/5 +1 of the Senate indicate that they would not vote to end debate if someone did decide to talk, the threat is real.
What would be interesting (and maybe is the point you are trying to make) would be for the majority party to call the minority party’s bluff and say, “OK, we’re going to bring this legislation up, and one of you can feel free to talk about it as long as you can. After you collapse, we’ll vote on it.”
That is precisely what I am saying.
